  1. Purpose of your personal data processing.
  • POTENTIAL RESIDENTS:
  1. Handling applications.
  2. Informing on the service and entertainment offer.
  3. Monitoring during the registration process.
  4. Sending information on novelties at the centre even if the registration has not yet been formalised.The data provided will be erased automatically a year after information on our centres was requested, unless you request they be erased before that date.
  • RESIDENTS, FAMILY AND RELATIONS:
  1. Handling applications for registration at the centre.
  2. Administrative control and management, managing collections from and payments to residents.
  3. Actions that may be necessary to manage assistance and medical care.
  4. Sending personalised communications to residents to inform about services, products and news related to BALLESOL centres.
  5. Preparation of anonymous statistics to be included in scientific research.
  6. Carrying out satisfaction surveys and handling complaints and suggestions forms.We hereby inform you that the data provided will be automatically erased fifteen years after you are no longer registered at our centres, unless you request they be erased before that date.

    Also, if you give us your consent, BALLESOL may send you personalised marketing communications by any means, for instance the Ballesol magazine, which shows the activities carried out at Ballesol centres, even after the contractual relationship is extinguished.

    Whenever activities or events take place at BALLESOL centres, where the residents and staff are the protagonists, pictures will be taken and videos will be recorded in which your image may be captured.

    If you give us your express consent, we may process your image with the purpose of disseminating it in marketing communications, the news section, website contents or the media, as well as to publicise BALLESOL services and entertainment proposals via the Ballesol magazine and for publication on social media where the Party responsible is present, for instance Facebook, Twitter, LinkedIn, Google +, Instagram and YouTube.

    If you have provided us with third-party data, you hereby declare that you have that person’s consent and you undertake to pass on the information contained herein to that person.

  • CONTACT US AND FIND YOUR BALLESOL CENTRE FORM. 

    You are hereby informed that BALLESOL will only process the personal information you provide in the contact form and exclusively for the purpose of sending you the information requested, as well as to solve any doubts or questions you may ask.

  • NEWSLETTER SUBSCRIPTION FORM. 

    BALLESOL will only process the personal data you provide in the contact form and exclusively for the purpose of sending you press releases and the news bulletin by email.

  • WORK WITH US FORM. 

    BALLESOL will compile and process the personal data of candidates provided on the form to include them in the selection processes. The application documents will automatically be erased six months later, unless you ask they be erased before that date. However, if the candidate is selected, the data provided will be stored in order to manage the employment relationship in accordance with legal requirements.It should be noted that if the data requested in a form is not provided, it means that the application will not be processed.

    Therefore, in order to meet this purpose, it is important that you inform us of any changes in your personal data so that we may keep them updated, because we are not answerable for the veracity thereof.

    We hereby inform you that BALLESOL centres are equipped with cameras, video cameras and any other similar technical devices that will capture and/or record images of individuals who are identified or identifiable, for surveillance purposes, but private conversations will not be registered.

    Cameras will only capture or record images in the areas that are essential to ensure security, and in no event will they be located in residents’ rooms, changing rooms, bathrooms, workers’ rest areas or similar places, or in third-party areas.

    In all the centres, sufficiently visible signs have been put up in places accessing monitored areas, which clearly indicate the identity of the party responsible whom you should address and where you must go to exercise your data protection rights and where to obtain further information on data protection.T

    The images will be retained for a maximum term of one month after they are captured or recorded, after which they will be erased. However, if an offence or crime or an administrative infringement is recorded which must be communicated to the authorities, the images will be conserved for the sole purpose of making them available to said authority and they will not be used for any other purpose.

  1. Retaining personal data.Your data will be retained as long as the contractual relationship lasts, as well as to meet the responsibilities that may arise from the data supplied and from any other legal requirements.

    Subject to the foregoing, once you are no longer a resident of our centres, the data compiled on the resident, family members and/or relations will automatically be erased fifteen years after you are no longer registered at our centres, and if you have only requested information, the data you provide will automatically be erased one year after that date, provided you do not ask us to erase them prior to that date.

    If you send your data via the Trabaja con nosotros [Work with us] form, the application documents will automatically be erased after six months, unless you ask for them to be erased before that date.

    The images captured and/or recorded by video surveillance cameras will be retained for a maximum term of one month after they are captured or recorded, after which they will be erased. However, if an offence or crime or an administrative infringement is recorded which must be communicated to the authorities, the images will be retained for the sole purpose of making them available to said authority and they cannot be used for any other purpose.

    The foregoing is subject to the storing of images necessary for the purpose of filing, exercising or protection from potential claims and/or provided it is permitted by the applicable laws.

  2. Legal grounds for the processing of your personal data.The basis for processing the personal data of potential residents and residents, family members and/or relations is the necessary consent given for the execution of the contract with BALLESOL.

    Regarding the forms on our website, the legal basis for the processing is the consent given when ticking the “I have read and consent to my data being processed in accordance with the Data Protection Clause” box, before sending us the corresponding form.

    The data we request from you are suitable, relevant and strictly necessary and in no event are you under the obligation to provide them to us, but the non-communication thereof will entail that your contract will not be executed.

  1. Recipients of your personal data.BALLESOL shall only assign your data to third parties when you expressly authorise us to do so, unless there is a legal obligation to surrender the data. We hereby inform you that no international data transfers are planned.

    If you give us your express consent, we shall assign the personal data of residents to healthcare centres, pharmacies and healthcare professionals such as physiotherapists, chiropodists and orthopaedics specialists, to be able to carry out any necessary actions to manage the assistance and medical care of the resident, as well as to the official bodies requiring the information, in compliance with legal obligations.

    BALLESOL relies on the collaboration of third-party service providers who may access your personal data and who will process said data in the name and on behalf of BALLESOL as a consequence of providing services.

    It should be noted that BALLESOL follows strict criteria in the selection of service providers in order to comply with its obligations in the field of data protection, and it undertakes to sign the corresponding data processing agreement with them, whereby it shall impose the following obligations, among others: applying appropriate technical and organizational measures; processing personal data for the agreed purposes and solely following the documented instructions of BALLESOL; erasing and returning the data to BALLESOL once the provision of services has ended.

    Specifically, BALLESOL shall contract the provision of services from third-party suppliers who perform their activities, including but not limited to, the following sectors: logistics services, legal consultancy, authorisation of suppliers, multi-disciplinary professional service companies, companies related to maintenance work, healthcare assistance and service companies, IT service providers, physical security companies, instant messaging providers, infrastructure management and maintenance companies.

  1. Your rights when provide us with your personal data.Your personal data are processed in an absolutely confidential manner. Below you are informed that as the data owner or party concerned you may exercise your rights to:
  • Access: to enquire about your personal data processed by BALLESOL.
  • Rectification: you may amend your personal data if they are not precise or to update them.
  • Deletion: you may request that your personal data be deleted.
  • Objection: you may request that your personal data not be processed.
  • Portability: you may receive, in an electronic format, the personal data you have provided us with and those obtained from the contractual relationship with BALLESOL and transfer them to another residence.
  • Limitations on data processing: when you challenge the exactness of your personal data; when the processing is lawful but is opposed to deleting your data and instead you request the limitation thereof; when BALLESOL does not need to process your data but you need them to exercise claims or to protect yourself from claims; and when you have objected to the processing of your data for the fulfilment of a public-interest mission or to fulfil a legitimate interest, while it is verified whether the legitimate grounds for the processing prevail over your motives.You may exercise your rights at any time, by writing to BALLESOL, Calle Juan Álvarez Mendizábal, 3, 4º, 28008 Madrid – Spain, or to the email address provided for such purpose, dpd@ballesol.es, including in either case a photocopy of your Spanish ID Card or any other equivalent document.

    Forms and other information on your rights are available on the website of the relevant Spanish control authority, the Agencia Española de Protección de Datos [Spanish Data Protection Agency], www.agpd.es.

  1. Right to withdraw your consent.At any time, you have the possibility and right to withdraw your consent for any of the specific purposes granted previously, via the procedure described above, and this will not affect the legitimacy of the processing based on the consent given prior to the withdrawal thereof.
  2. Where to file claims in the event you consider your personal data are not processed suitably.If you consider that your data are not processed correctly by BALLESOL, you may file a claim with the relevant Spanish control authority, the Agencia Española de Protección de Datos [Spanish Data Protection Agency], www.agpd.es.
  3. What we do to guarantee the security and confidentiality of your personal data.With the aim to safeguard the security of your personal data, we hereby inform you that BALLESOL has adopted all the necessary technical and organizational measures to guarantee the security of the personal data supplied. All this is done to prevent the alteration, loss and/or unauthorised processing or access, as required in the regulations. Absolute security, however, does not exist.

    Likewise, BALLESOL informs you that all its staff, regardless of the stage of processing in which they intervene, have committed to processing your personal data with maximum care and confidentiality in accordance with the personal data protection laws in force, in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. We hereby remind you that neither BALLESOL nor any of its employees will assign or communicate your data to third parties, except in the cases provided by law, or unless you expressly authorize it.

  1. Amendment of this Annex on Data Protection.BALLESOL may alter this Annex on Data Protection to adapt it to the personal data laws applicable from time to time. In such event, the contents thereof shall be communicated sufficiently in advance by any means of communication provided for that purpose.
